PWNDU.AI — Rider Terms of Service (TOS)

Welcome to PWNDU.AI, a digital marketplace platform that connects Riders with independent transportation service providers (“Drivers”). By accessing or using the PWNDU.AI website or mobile application (“Platform”), you agree to the following Terms of Service.

1. Nature of the Platform

PWNDU.AI is a technology platform that enables Riders to request transportation services from independent, third-party transportation providers who operate their own businesses.

PWNDU.AI is NOT a transportation company, vehicle-for-hire operator, taxi service, or Transportation Network Company (TNC).

All transportation is provided solely by independent Drivers.

2. Eligibility

You must be at least 18 years old to use the Platform.

3. User Account

You agree to provide accurate information and maintain the security of your account.

4. Payment

Payments are processed through third-party payment processors (e.g., Stripe).

PWNDU.AI does not set pricing for rides; prices are set by independent Drivers.

5. No Control Over Drivers

Drivers listed on the Platform:

• Are independent business entities
• Are not employees, agents, or contractors of PWNDU.AI
• Determine their own pricing, schedules, and acceptance of rides

PWNDU.AI does not control, manage, supervise, or monitor Drivers.

6. Assumption of Risk

By using the Platform, you acknowledge that transportation involves inherent risks including:

• Motor vehicle accidents
• Injury
• Property damage
• Interactions with third parties

You voluntarily assume these risks.

7. Limitation of Liability

To the maximum extent permitted by law:

PWNDU.AI is not liable for any injuries, losses, damages, or incidents occurring during or related to transportation provided by Drivers.

PWNDU.AI is not liable for:

• Driver actions or omissions, or verbal speech
• Vehicle safety or condition
• Insurance coverage
• Criminal or negligent acts
• Cancellations, delays, or failure to perform services

8. Dispute Resolution — Mandatory Arbitration

All disputes must be resolved through binding arbitration, not court.

Class-action lawsuits are waived.

9. Indemnification

You agree to indemnify and hold harmless PWNDU.AI for claims arising from your use of the Platform.

10. Termination

PWNDU.AI may suspend or terminate accounts that violate these Terms.

11. Governing Law

Florida law governs these Terms.
